Midnight Chat Terms of Service

Effective date: October 6, 2026

These terms are an agreement between you and Midnight Chat ("the app", "we", "us"). By installing or using the app you accept them. If you don't agree, please don't use the app.

1. Adults only

Midnight Chat is only for adults aged 18 and over. By using it you confirm that you are at least 18 and old enough to agree to these terms where you live. We may suspend any install we believe is used by a minor.

2. Content rules

You must not use the app to create, request or share:

• any sexual or sexualised content involving minors, or characters, pictures or roleplay that present or suggest a minor in a sexual way;
• sexually explicit content or nudity (the app is for romance and flirting, not explicit material);
• content that harasses, threatens or promotes hatred or violence against real people or groups;
• content that is illegal, or that infringes someone else's rights (for example a real person's likeness or private photos without their permission).

Child safety: zero tolerance. We have zero tolerance for child sexual abuse and exploitation. An always-on child-safety filter checks replies, character descriptions and pictures, and it can't be turned off. Accounts involved in such content are suspended, the content is removed, and we report child sexual abuse material to the NCMEC CyberTipline and to authorities as the law requires. 3. Characters you make

• You are responsible for the characters you create and for what you write in them.
• If you choose to share a character, it is public: other users can see and chat with it. You give us a free, worldwide licence to host, show and distribute it in the app for as long as it is shared.
• You can stop sharing a character in the app. To have a shared character taken down, or to report one that breaks these rules or your rights, use Report in the app or email us. We may remove or hide any character or picture at any time, with or without notice.

4. Premium

• Premium is a subscription sold through Google Play. Prices and billing periods are shown in the app and in Google Play before you buy.
• Free trials, when offered, turn into a paid subscription at the end of the trial unless you cancel before it ends.
• Subscriptions renew automatically until you cancel. You can cancel at any time in the Google Play Store app (Profile → Payments & subscriptions → Subscriptions). Cancelling stops the next renewal; Premium stays on until the end of the period you paid for.
• Payments and refunds for subscriptions are handled by Google Play under its policies.

5. Coins

• Coins are virtual items used inside the app (for example for pictures, extra time or redraws). You can buy them through Google Play or earn them in the app.
• Coins have no cash value. They can't be exchanged for money, transferred to another person or install, or cashed out, and they are not property you own; you have a limited licence to use them in the app.
• Purchases of coins are final and non-refundable, except where the law or Google Play's policies require a refund. Coins that are refunded or charged back may be removed.
• We may change coin prices and what coins can be used for. Coins have no value outside the app and are lost if you uninstall without a backup, if your install is suspended for abuse, or if the service ends, except where the law requires otherwise.

6. Abuse and suspension

We may limit, suspend or end your access, remove content, or take back coins or rewards gained unfairly, if you break these terms, abuse the service (for example by cheating rewards, invites or ads, attacking or overloading our servers, or tampering with the app), or if the law requires it.

7. AI may be inaccurate

Characters are fictional and their replies and pictures are made by AI. They can be wrong, inconsistent or unexpected, and they are not facts or advice (medical, legal, financial or otherwise). Don't rely on them for important decisions. If you are in crisis, contact your local emergency services.

8. The service is provided as is

The app is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't promise that it will always be available, error-free or that content or features will stay the same. To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of chats or coins. Nothing in these terms limits rights you have under the law that can't be limited.

9. Privacy

How we handle information is explained in our Privacy Policy.

10. Changes

We may update these terms as the app changes. We will show the new effective date at the top and tell you in the app about important changes. If you keep using the app after a change, you accept the new terms.
